Urban Property Ownership Records Repository- A giant step in the right direction

You may have heard about Unique identification card project being implemented to build a database of all Indian residents, but not about the real-time database of the property ownership records of every piece of land owned by people in the country. For those who own or plan to buy a property in the form of land or house/apartment in Karnataka, here is some good news, you do not have to go after the legal experts or make rounds to the revenue office to obtain property ownership details. Imagine a system where you can simply submit request online with a survey number and property schedule details, you would get the answer on the history of ownership right of the property with full details, in a minute or two. Sounds good right, if you own a property in Karnataka, you would certainly see this happening in next couple of years, if the state government initiative to create a first of its kind in the country, urban property ownership records(UPOR) is going to become a reality.

Mammoth Task
It is not going to be an easy task for the government to complete the survey of all the lands in urban areas in a short span of time, as there would be several lands in dispute and cases pending in the courts on the conflicting ownership claims. Perhaps, the decision of the Karnataka state government to take up this project in public private partnership mode(ppp) might help achieve the milestones as envisaged in the proposal. As a first step the Department of Survey Settlement and Land Records will need to create property records by surveying all urban properties and verifying ownership titles. This data obtained will be processed to create an electronic repository of property records. One can imagine the quantum of work as there are nearly 8 lakh properties in only the five selected cities, Shimoga, Mangalore, Bellary, Mysore and twin cities of Hubli-Dharwad. The cost estimated for this pilot project is around Rs. 40 crore, and the repository will be ready for use by September 2010. Subsequently, the government plans to implement the project for other 276 urban and townships in the state.

Multipurpose UPOR
The benefits envisaged of this UPOR system are multifold, it is a win-win for all the parties involved. It is expected to consolidate and cleanup the property records in urban areas where it is increasingly becoming difficult to maintain ownership details. This will end the current system of multiple document storage and duplication of work for both registration and revenue departments.

At present all municipalities maintain khata(term used in Karnataka) records of properties, which are primarily used for the purpose of tax collection. The new system will avoid overdependence on the khata records. As of now it has become a practice that, in the absence of any proper regulated system of property record, the municipal/town khata records have become a deemed tax record and citizens pay property tax to demonstrate their ownership over a particular property.

Property owners holding genuine ownership titles to property will be guaranteed of their ownership and prospective buyers/investors get assurance in the form of UPOR, which promises to offer the genuineness of the property put up for sale or lease. Moreover, this is expected to benefit loan against property/mortgage players, particularly public and private sector Banks to reduce their turnaround for processing the loan applications. They will be sure of lending loan against property.

The new system is also likely to help urban planning as it is expected bring in more efficiency to the building plan approval process, importantly, protect the government properties from being encroached by the unlawful elements.

This project, a first of its kind in the country, once implemented, the property owners can feel more secured about their investments, and those property owners apprehensive about the dubious transactions by unlawful forces can enjoy peace of mind. The Urban Property Ownership Records (UPOR) project in Karnataka is expected to not only prevent such illegal transactions, but is also expected to increase property tax collection as all urban local bodies will have easy access to the finer details of a comprehensive database of all properties in their cities/towns, which will help them plug the loopholes in the current property tax collection process.

Once the project is live, the UPOR certificate will be the only valid ownership certificate for all property transactions, related to buying, selling, or leasing etc. The Karnataka Stamps and Registration Department will register transactions of only such properties that exist in the UPOR system. Overall, property owners, the biggest beneficiaries of this project, should be provided an environment where they could invest their life-time savings on property purchase and maintain peace of mind. This makes the UPOR repository system a single point reference for all property records and help establishing the true ownership of the land. This project once implemented, would help all the stake holders a great deal, therefore, let us hope the other states in the country also start implementing similar projects as early as possible.
